Terms of Service

These Terms of Service ("Terms") govern your access to and use of PawScheduler ("Service"), operated by PawScheduler ("we," "us," or "our"). By creating an account or using the Service in any way, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of Service

PawScheduler is a web-based scheduling and client management platform designed for solo and mobile dog groomers. The Service includes:

2.1 Eligibility

You must be at least 18 years old to create an account. By registering, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.

2.2 Account Responsibility

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect unauthorized access to your account.

2.3 One Account Per Groomer

Each groomer may maintain one active account. You may not share your account with others or create multiple accounts to circumvent subscription limits or trial periods.

3. Free Trial

New accounts receive a free trial period of 30 days (or 60 days for eligible pilot program participants). No credit card is required to start a trial.

At the end of your trial period, your account will be restricted until you subscribe. Your data will be retained for 30 days after trial expiration, after which we may delete your account and all associated data if you have not subscribed.

4. Subscription and Billing

All prices are in US dollars and exclude applicable taxes.

4.2 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. By subscribing, you authorize us to charge your payment method on a recurring basis.

4.3 Payment Processing

All payments are processed securely by Stripe. We do not store your payment card details. By providing payment information, you agree to Stripe's Terms of Service.

4.4 Failed Payments

If a payment fails, we will attempt to retry the charge. If payment cannot be collected, your account may be downgraded or suspended until payment is resolved.

4.5 Refund Policy

We do not offer refunds for partial months or unused subscription time. If you cancel mid-period, your access continues until the end of the paid period. Exceptions may be made at our sole discretion โ€” contact us at [email protected].

4.6 Price Changes

We reserve the right to change pricing at any time. We will provide at least 30 days notice before any price increase takes effect for existing subscribers.

5. Cancellation

You may cancel your subscription at any time through your Profile page or by contacting us. Upon cancellation, your subscription remains active until the end of the current billing period. No further charges will occur after cancellation.

We may suspend or terminate your account for violations of these Terms, non-payment, fraudulent activity, or abuse of the Service. We will provide reasonable notice except in cases of serious violations.

6. SMS Messaging Terms

Clients may opt out of SMS messages at any time by replying STOP. PawScheduler automatically processes opt-out requests. Groomers must not re-enroll clients who have opted out without obtaining new explicit consent.

6.4 AI SMS Scheduler

The SMS AI scheduling assistant is powered by Anthropic's Claude AI. Conversations with the assistant are used to provide the scheduling service. The assistant may make errors โ€” always verify critical appointment details within the app. PawScheduler is not liable for scheduling errors resulting from AI misunderstanding.

8. Client Data and Groomer Responsibilities

Groomers using PawScheduler are responsible for the client data they enter into the system. By adding client information, you represent that you have the right to store and process that information in connection with your grooming business.

You are responsible for complying with all applicable privacy laws (including CCPA and any applicable state laws) with respect to client data you collect and store through PawScheduler. PawScheduler is a data processor acting on your behalf as a data controller for client records.

You must not store sensitive financial information, Social Security numbers, or medical records beyond what is necessary for pet care (e.g., vaccination dates) in PawScheduler.

9. Intellectual Property

9.1 Our Property

PawScheduler, including its software, design, branding, and content, is owned by PawScheduler and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our permission.

9.2 Your Data

You retain ownership of all data you enter into PawScheduler. By using the Service, you grant us a limited license to store, process, and transmit your data solely to provide the Service to you.

10. Third-Party Services

PawScheduler integrates with third-party services including Stripe, Telnyx, MailerSend, Supabase, Netlify, and Anthropic. Your use of these integrations is subject to those companies' own terms of service and privacy policies. We are not responsible for the actions or content of third-party services.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

We do not warrant the accuracy of AI-generated scheduling suggestions. Always verify appointment details within the application. We are not responsible for missed appointments, lost revenue, or client disputes arising from scheduling errors.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAWSCHEDULER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless PawScheduler and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights including privacy rights of your clients.

14. Service Availability and Changes

We strive for high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will provide reasonable advance notice for planned downtime.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. If we make material changes that negatively affect you, we will provide at least 30 days notice.

15. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Pennsylvania.

Before initiating any legal action, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date and notify active subscribers by email if changes are material. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PawScheduler regarding the Service and supersede any prior agreements.
